Article 9 — Persons voluntarily acquiring citizenship of a foreign State not to be citizens

  1. Persons voluntarily acquiring citizenship of a foreign State not to be citizens.—No person shall be a citizen of India by virtue of article 5, or be deemed to be a citizen of India by virtue of article 6 or article 8, if he has voluntarily acquired the citizenship of any foreign State.

Plain English Summary

This article states that if an Indian citizen voluntarily chooses to become a citizen of another foreign country, they automatically lose their citizenship of India. This prevents dual citizenship where an individual claims citizenship in both countries simultaneously.

Key Points

  • Voluntarily acquiring citizenship of a foreign state disqualifies a person from being an Indian citizen under Articles 5, 6, or 8.
  • This rule applies to individuals who consciously take on the citizenship of another nation.
  • It is a provision designed to maintain clear national identity and prevent conflicting loyalties.

Why It Matters

This clause helps India manage situations where an individual might have conflicting legal statuses regarding nationality, ensuring that citizens are clearly defined as belonging to one nation.
